OCTOBER LUNCH PANEL DISCUSSION: LATEST LEGAL DEVELOPMENTS

Presented by Gregg Kronenberger, Ted Smith and Tom Nesbitt.

The lunch presentation will feature a panel of attorneys that specialize in labor and employment law.  The panel will discuss important legal developments including: Enhanced DOL enforcement measures for the FLSA, The Employee Free Choice Act,   What does EFCA mean for employers, Status of legislation, what elements are likely to become law, and How to prepare for EFCA.  The lunch session will conclude with Q & A.

Mr. Gregg Kronenberger

Gregg Kronenberger has been assisting employers in all aspects of labor and employee relations for 17 years. He counsels and trains employers on compliance with federal and state laws, and represents and advises employers in lawsuits under statutes prohibiting discrimination, establishing wage and hour standards, and otherwise regulating employment. Gregg also represents employers in administrative proceedings before the National Labor Relations Board, the Equal Employment Opportunity Commission, the Occupational Safety and Health Administration and other state and federal agencies. He regularly works with unionized employers on labor management relations, negotiates collective bargaining agreements, and represents employers in arbitration hearings.

Mr. Kronenberger earned his B.S. and J.D. degrees from Louisiana State University, and is listed in The Best Lawyers in America. Thomas A. Nesbitt, DeShazo & Nesbitt, LLP

Mr. Nesbitt is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization.

He is admitted to practice in the U.S. District Courts for the Western, Southern and Northern Districts of Texas and the U.S. Court of Appeals for the Fifth Circuit. Prior to founding DeShazo & Nesbitt, Tom was with the Austin office of Fulbright & Jaworski.

Mr. Nesbitt has successfully represented clients in a variety of labor and employment matters, including covenant not-to-compete drafting and litigation, trade secret litigation, cases brought before the National Labor Relations Board (NLRB), and employment discrimination and unlawful termination litigation. He often consults with employers about compliance with state and federal laws and regulations, the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), employee policies and handbooks, Equal Employment Opportunity (EEO) training, drug testing, and managing employment performance and disciplinary issues. Mr. Nesbitt has recently represented a semiconductor manufacturing company, several national banks, hospitals, a physician’s group, two electrical contracting companies and many other businesses of all sizes.

He received his J. D. with honors from the University of Texas School of Law and his bachelor’s degree in English from Baylor University.

He was selected as a Rising Star by the Texas Monthly magazine 2004 through 2007 and was also listed in Best Lawyers in America in 2008. Tom is active in legal professional organizations and is also very active in the community. He is Co-Author of “Polygraph Tests and Drug Testing,” The Texas Employment Law Handbook – A Guide for Employers, Chapter 20, Texas Association of Business, 2004; Contributing Editor, The Developing Labor Law 2003-2005 Supplements and authored “Texas Workforce Commission Adopts Payday Act Rules” in The Texas Labor Letter, January 1999. Mr. Nesbitt speaks frequently at seminars on labor and employment law topics.

Mr. Ted Smith

Ted Smith is Board Certified in Labor & Employment Law by the Texas Board of Legal Specialization. Since 2003, Mr. Smith has been selected as a “Texas Super Lawyer” in the field of Employment Litigation or Labor and Employment Law by Texas Monthly magazine.

Mr. Smith specializes in representing employers in management / union relations, as well as all aspects of the non-union employer-employee relationship, from litigation and appeal to training and advice. In particular, Mr. Smith has significant experience litigating and counseling clients regarding federal and state employment statutes (including Title VII, TCHRA, ADEA, ADA, WARN, and the NLRB), as well as wrongful discharge matters, individual employee rights issues, retaliation under workers’ compensation laws, and matters related to union and individual employee arbitrations. His experience also includes addressing international employment issues.

Mr. Smith graduated from the University of Notre Dame (B.B.A., cum laude, 1991) and received his J.D. from the University of Texas School of Law in 1994. Upon graduation from law school, Mr. Smith served in the United States Army Judge Advocate General’s Corps, where among other aspects of his practice, he litigated federal labor and employment claims before the EEOC, the Merit Systems Protection Board, the Office of Special Counsel, and the Office of Special Complaints. Thereafter he joined the national labor law firm of Littler Mendelson in Dallas, where he litigated a full range of labor and employment issues in state and federal court, and also gained experience in representing employers in labor grievances, arbitrations, and union elections. Mr. Smith joined the Austin office of Jenkens & Gilchrist in 2000, where he continued his labor and employment law practice until co-founding Cornell Smith & Mierl in 2003.

Mr. Smith is a member of the Texas Bar Association, Austin Bar Association Labor & Employment Law Section (Secretary 2003-2004; Treasurer 2004-2005; Vice-Chair 2005-2006; Chair 2006-2007), and the American Bar Association. He is licensed to practice in the Fifth Circuit Court of Appeals and the U.S. District Courts for the Northern, Western, Eastern, and Southern Districts of Texas, the Eastern and Western Districts of Arkansas, and the U.S. Court of Appeals for the Armed Forces.
